hanging around a girl from our block.she was 13 at the time.i told her mother that they were hanging out alot,and that my step son is sexully active.well to make long storie short he got her pregant.my lovely grandbaby born may 1st.2006 bethany martinez.my problem is that we the grandparents want the best for her,and the girls parents drink cant keep a job and dont have thier own house.i fear that her mother being so young and her other grandparents being unstable she not being taking care of right.i dont want her to be taking away from the mother but to maybe have vist rights or even have that girl live with us,what do you think?

GRANDPARENT'S RIGHTS

Q. My parents would like to take my children for the weekend or during part of the summer. Do I need the custodial parent’s permission to do this?

A. Usually no. During your periods of possession of the children you have the right to allow the children to visit their grandparents, spend the night at a friends, or any other such activity as long as they are returned to the other parent on time. You may allow your parents to take the children on a vacation, even out of state, during the summer.

Q. What rights do the grandparents have in Texas?

A. There are no automatic grandparent’s rights in Texas. Unless they go to court, they have no rights to visit the grandchildren. This does not mean they cannot see the grandchildren. It simply means they must have the approval of one of the parents. Under some circumstances, grandparents can obtain a court order to visit with grandchildren over the objection of the parents.

Q. What rights can the grandparents get in court?

A. There has been a lot of debate in the law over the last few years. However, as it stands now, the grandparents may petition the court for visitation and the judge can grant specific periods of visitation over the objections of the parents.

Q. Can the grandparents get custody of my children over my objection?

A. Maybe. Grandparents can petition the court for custody of your children if the children have lived with them for at least 6 months and they file the petition for custody within 90 days of when the children stopped living with them. They may also petition for custody if there is an emergency situation which endangers the health or wellbeing of the children. However, they have the burden of proof and it is a difficult burden to meet. It is not enough to simply show that the children are better off with the grandparents; they must also prove that living with a parent would be harmful to the child.

Are the girls parents abusive towards her or the child? I understand your concern, but with them both being so young it's hard to say. Did you even discuss her coming to stay with you with her? She may welcome the opportunity, but your son may not. You have a lot to think about while considering all the options. She is still a child herself, what are her parents reaction towards her even having a child? Sorry but to really help, I'd need alot more info.

You could certainly help her out by visiting her and helping her buy supplies for the child. It would be a tough legal case to get her removed from her parents and into your home. Perhaps they would let her live with you willingly. It could be an agreement where she would live with you in lieu of child support. Are she and your stepson still together? If not it would be awkward for them to live under the same roof.

I think if you can prove the mother and her family are unfit, you may have a chance in court. However, what your step-son did, intercourse w/ a minor, is illegal and he could be prosecuted, depending on the laws in your state.

It's hard being the parent of boys. what your dealing with is one of my worst fears, my son getting a girl pregnant, combined with the fact that the family is irresponsible.

You have no control over this situation, that's the worst part.

I would take the girl in if her parents don't object, take into consideration that the mom of your gran baby is also a baby herself, and probally thinks she capable of taken care of her baby, but I bet she's really sceared, her parents may let her and the baby live with you, you can't hurt by asking.....

Perhaps you could see if your stepson, or you and your husband can get custody of the baby. If not, I think It would be a good idea to have the girl live with you, giving the baby both of her parents.
