Consult a good immigration lawyer if an application is made for a visa it will likely end in a deportation hearing and possible deportation. If this happens there will be no way to come back since there is a record of the deportation. It would be better to have a lawyer apply for landed immigrant status due to circumstances and on humanitarian grounds.

It is not correct that you cannot become legal after an illegal crossing. People have become legal after crossing a few times illegally. Depending on his circumstances, he may want to seek out an attorney, if you go to Catholic legal services they will be more than happy to help. Or he could simply apply for whatever kind of visa/green card he wants. He'll have to do it the same way as everyone else though.

P.S- they extended that amnesty until 1995 or so, he may want to check if the deadline has been renewed. You have to go and register to get it(amnesty), and he'll probably have to prove he's been here all this time.

This spring the government gave amnesty to all long term citizens. If this person has been living here for that long then they should be eligible for a visa. Eventually they would be allowed citizenship.

Amnesty is offered to long time residents without a VISA. Inquire if this law is still in effect.
