If it can be proved that the person was aware of their condition, and they willingly led their partner to believe they were not ill and spread HIV to that person, criminal charges such as attempted murder can be brought forth.

Most States have laws that require an HIV positive person to disclose his/her status prior in engaging in any sexual penetration.

Whether HIV is transmitted or not, it is considered a felony. Depending on the state it's punishable by 10-15 years in prison.

Yes, a person could be charged with reckless endangerment, possibly even attempted murder, but the court would have to prove that the person knew that they were HIV positive.

Yes. Of course. It is completely illegal to transfer HIV/AIDS, but only if you know you have it. When you go to a doctor and they find out you are positive, it is recorded.

I believe one could be charged with attempted murder. Maybe even worse when that person dies.
