Not according to the news this morning. A sandwich shop in CA opened in a mall with the clause that no other sandwiches could be served in the mall. A Mexican bar and grill opened next to them, and the sandwich place took them to court for serving burritos because they considered that a sandwich.
The judge found in favor of the Mexican place and dismissed the case, saying a burrito is not a sandwich.

To the average person, a burrito and a sandwich is different. A sandwich uses bread while a burrito uses a tortilla.
However, to certain lawyers they are the same thing.
I'm assuming you're asking this question as a result of the lawsuit between Panera Bread Co and Qdoba Mexican Grill.
In Boston, Panera Bread Co. has exclusive rights to sell sandwiches in a mall. Panera tried to prevent Qdoba from opening up in a mall because Panera claimed that burritos, tacos and quesadillas are sandwiches. Of course, the judge ruled against Panera Bread Co, see article in below link.
What a silly lawsuit... Dang weasly lawyers.
I was looking at investing in Panera, but this takes the cake. I'm not going use any of my dough to buy Panera. Panera kneaded to be put in their place. I'm glad the judge put this case under wraps.

A burrito is like a sandwhich, but it is NOT considered a sandwich.
A burrito has beans, meat, rice, and toppings like shredded cabbage, tomatoes, and cheese, but instead of being between two slices of bread it is inside a tortilla. A tortilla is a round flat "wrap"-like product (unleavened bread). All of the contents are put on top of the tortilla and the tortilla is wrapped around the contents. You eat a burrito with your hands (most people do).
They are mighty delicious, as well!

A sandwich uses BREAD! That is what makes it a sandwich. Any filling between two (or more) slices of bread. That is the way the Earl of Sandwich took his meals when playing billiards, that's the food they named after him, bread, meat, bread = sandwich.
The "taco" is a Mexican dish with food rolled inside a flat "tortilla" an ancient native Mexican corn-meal flat "cake," (but it is NOT "bread.") The burrito uses a larger type of tortilla so it COULD be considered to be a type of "taco" but NOT a sandwich!

It's beans, ground or shredded meat, cheese or other filling rolled up inside a flour tortilla. So, it's not exactly a sandwhich, but is held with the hands to eat...so works the same way. Breakfast burritos are rolled up with scramble eggs, meat, cheese, sometimes pototoes, and oh so good and easy on the go.

yes, a burrito would be considered a sandwich because the bread industry in mexico is not very good. after eating bread from the u.s it gives you a great comparison.. Mexicans do make excellent Sweet Bread, though..
