The restraining order could be invalidated by a petition for mandamus under the Rules of Court citing that the order if prolonged will cause damage to the petitioner or his property. That the order was just filed to cause delay and the reasons for issuance of the order was not meritorious.

Restraining Orders are civil and not criminal. Do you mean a Protective, No Contact Order, Ex-Parte Order, or Civil Ex-Parte Order. Restraining orders are removed by the person who requested them. The others usually involve a judge.

It depends on what type of restraining order is taken out.Most of them can be dropped by the person that filed it.Some have to be dismissed by a judge.
