My husbands ex wife is using my husbands criminal history from almost 20 years ago against him. They share other children together and everytime he goes to court for visitation she uses his past history. So he does't get to see his other children. Child Protective Services is very familiar with her, because she always calls them and makes complaints and alligations against him. His criminal past deals with a sexual charge, in which at the time he was about 19 years old, his girlfriend was about 16, the parents didn't like him and pressed charges, he was scared and took a plea bargain. He served his time of a few years, and was released. He is not on Megans Law or any law of that sort. But his ex keeps using his past in every court case that they have. What do we do?

What she keeps bringing up is IRRELEVANT. At least I would think so since it happened so long ago.

Well Dear, don't think it's harassment, but I'm not an attorney. A criminal record is a public record, meaning anybody form anywhere can view, criminal record from courthouse where convicted. Shouldn't be any reason for harassment for it is a matter of public record, any and all has access to it. Doesn't seem fair, if your husband did his time. But just as marriage license, death certificates, birth certificates, divorces, any conviction of criminal activity is all for the public to see.

HARASSMENT,, Take her to court first!!! Sue for FULL custody Then settle for the every other weekends. Get an afidavid from the 16 year old he was charged with at 19.. Have her testify,,

not much you can do ... she isn;t harassing him, she is just using his record against him ... he needs a smarter lawyer that can demonstrate that his past record does not apply and that he has a right to see his children ... if she is filing false complaints against him, that is a criminal act and he should bring her up on charges for it. if nothing else, it will level the playing field. ... if on the other hand, her complaints are valid, then he is just shooting himself in the foot by not dealing with her strictly through his lawyer

that's the problem when a person sleeps with an underage girl.... the reprecussions haunt them for a long time....a hard lesson to learn.

Has he tried to get supervised visitations?... I know of parents who've gotten supervised visitations.... also have a good lawyer on hand who knows about his past offense .... because something doesn't sound right ...

It's not "Blackmail". Blackmail is when you hold a secret over someones head to get them to do what you want or give you something. Perhaps "Defamation of Character" is the term you're referring to. Ex-wife is trying to make your husband look bad.

it sounds like his ex-wife is a little crazy, and she needs to leave the man be. he needs to tell the judge that the past is the past, and he is a changed man. people change and mature in many ways.
