Why are commercials always allowed to lie.
For example: This DVD is the #1 movie in America

How is the #1 movie in America determined
and if there is a way, why is every movie #1?

If you are going to say it is protected under freedom of speech or freedom of the press, it can't be. If they are lies, it is slander, which is not protected under the first amendment, or any amendment for that matter.

Its not like they're opinions either. If they were they would say "We think the movie is the #1 movie in America"

So how are they allowed to do that?

Movies are ranked by the ticket sales.

DVD’s a ranked by DVD sales. If you have the most DVD sold for that week, then you have the number 1 DVD in America.

the way i see it its like a person saying this the the #1 dvd in america. u would take that as their opion but if they said that its a proven fact that this is the #1 dvd in america then it would be a lie. unless proven through polls and stuff. But usally there #1 thing is based on the votes of the cridics. if it get a 10 out 10 or so then they say stuff like its the #1 moive and stuff. unless they have a disclaimer.

That's not the issue. Your objectivity is up. You're thinking. It doesn't matter what they do. You're what's important. Here, a German language film I saw a while back called ' Men ' about a guy who's wife leaves him. Then he gets to know the guy she goes with. He finds they're both artists, he the more commercial, succesful, coaches him. Toward the end, there's a polite argument between him and the guy who owns/runs the place. ( Quote; )

" This is an advertising agency, we're not concerned with the truth here. "

Different research and different ways of doing research yeilds different results. The people who make the commercials pick the research thats supports their claims.
