I may be paranoid, but I think the police in our town are out to get us! They've never been very friendly and I even saw them listed on an Internet site involving police harrassment. They restrained my spouse after a seizure with handcuffs (& now has severe nerve damage) We have mentioned suing but not to them). Now they refused to respond to a 911 call on Sat. On Sun. my spouse was in a huge car crash. Though our car was broadsided by the other car and hurled 30 feet onto its side, (the small car that hit it MUST have been speeding!), they refused to give us info about the driver or anything 'til the next day, produced 3 witnesses who were nowhere in sight, AFTER charging my spouse with "failing to yield"! We've already been turned down by 3 lawyers regarding suing the cops for the handcuff case, so we wonder where to turn, legally and wonder if they are treating us like this because they think we're about to sue. Also, if we DO, whom do we turn to if the COPS are harrassing us?!

As to the question of whether we're "bringing this on"? If they think so, they're hallucinating! We keep to ourselves, rarely complain about the neighbors, though there are plenty we COULD say. The only dealings we've had w/these cops in the past 6 yrs. have been medical (illness and one bike accident and the seizure incident), somene ELSE's criminal activity (two B&E's on our property) and a complaint about harrassment from a dog owner. That's it! No traffic tickets even. I don't get it! There IS a "good ol' boy" mentality in this town, and maybe we just don't "count! People say the same about the schools, which is why our kid attends a different school. Maybe we should send the cops a freaking fruitbasket!

Such behavior shouldn't be tolerated from a public official. Remember, everybody answers to somebody. I don't care who you are or who you think you are. It's all the same. You need to get other citizens together and gather all your info on all misconduct and go to the State Attorney General's office.

There are two thoughts on seizures, one is to restrain them to keep them from hurting themselves and the other is to allow them to remain mobile. Each has its own benefits and drawbacks, depending on which doctor you ask and all of them have a theory. Whenever I have a prisoner (not talking about your incident) I try to keep them from hurting themselves by restricting their movement, but this requires 4-6 people. There is also the concern that the officer may be injured in the attempt to restrain the seizure victim which makes handcuffing an expedient method. There is also the question of what the officer’s policy is when encountered with this dilemma. If it is to restrain, then they performed to expectations. There is also the question that you must ask yourself, is if they didn’t do anything, was their the possibility that your wife would have further injured herself which would bring you right back to the question of whether or not you should sue the officers and the department. If you can fairly ask yourself these questions the answer will be evident.

Walk right in to the police station and fill out a complaint. Every day until something is done. Go to the district attorney. Right your Representative your congressman, right a letter to the newspaper until they put it in. Be polite just like in this question. But what ever you do, Don't Stop, Don't Let Up. Keep the heat on. Your rights as in the Bill Of Rights is only a piece of paper until it is exercised. I to have been abused and I plan on going after them with vengeance, with legal vengeance!

This is only my opinion. I am not fond of the "police" mentality, however, from my own personal experience I have never known a cop to treat anyone badly that in someway didn't have it coming. That doesn't mean though that there are not "bully" cops. There are. If you are trully being harrased, then it wouldn't hurt to sit down and talk to them. Letting someone know how you feel is an honerable and respectable thing to do. But seriously, are you doing anything that invites this harasment from them? Are you doing things that puts you in their pathway alot? I ask these questions out of respect to you, because I have found myself in a situation more than once where I was constantly in front of the police, and mad at them, and it usually was something I asked for even though I couldn't see it at the time.

Have you filed complaints with the city? Has to be done, or it looks as if it's an "okeydoke" from you.
Most attorney's won't take the case if the City is not monetarily well off. Complain to your state Attorney General, request an investigation.
Have a news station that investigates? Call them.

I find it hard to believe that you can't find a lawyer that isn't chomping at the bit to stick it to the city and the PD. If it is a small town and they don't want to ruffle feathers, then at least they should be able to recommmend someone. If not, go to the next town over. A lawyer from there won't have any loyalties to your city.

Take notes, review your civil rights, and file a grievance. It is the start.
You feel victimized and I am not going to be one to put blames on anyone. But you want to make sure, when you complain, that they perceive you are the good guy.
