It's the person who ran across the streets fault, they knew the danger but made the decision to run across.

It would be mine for not looking before I walked across the street. What point are you getting at? This is a terrible analogy. Why can't you let people make their own decisions. Live your own life - that's what you have it for. Stop trying to live others for them.

Mine.
But if the way you tell me not to run across the street is by giving me a book written 5,000 years ago that has conflicting passages, obscure prophecies, and silly rules that no one in the 21st centruy woud live by...well, forgive me if I don't listen to that advice.

Legally, it depends on a lot of factors, like where exactly you crossed, was there a traffic light, etc.
Outside legal considerations, it doesn't matter whose fault it is. If you're dead, there's nothing the can be done about it.

Obiviously the dude or dudette who ran across the road. It's not your fault because tried to warn them and they didn't listen to you!

I see what you're trying to do, and it's a very bad analogy.
