It might not be right but the technical definition of Sexual Harassment is "Anything that makes another person uncomfortable." Yeah kid you not. However you have terms yourself for filing sexual harassment. I'd go to HR and file charges against her (should have done in the first place lol). I would also look into company policy and see what the rules are. In my office I might not fire you but you'd defiantly be buying a new copy machine!

I'm with Naomi on this one....Anything that makes another person uncomfortable can be sexual harrassment......
Sad thing is I know of a situation that happened---a fellow ask his boss to talk to a female co-worker to wear clothes that was less reveling ( she was showing way too much clevage) and she ended up filing harrassement charges against the boss and the other worker. I think she won the case.......
So really in a nut shell I believe she could file sexual Harrassment and possibly win....
Good luck.........

What you did is make a bad decision. You may face discipline.
You did not, however, sexually harass her because your actions do not meet the criteria. Specifically, sexual harassment concerns a pattern of conduct that is so "severe and pervasive" that it denies someone employment or educational opportunities.
Do not speak to this co-worker about her allegation. If she approaches you, refuse to address it at all.
If she files, then your defense is (1) that your action was stupid but not "severe" or "pervasive" and (2) that your action did not deny your co-worker any employment or educational opportunities.
You will be able to defeat any sexual harassment complaint based on your photocopying incident that way.

How was she able to take a picture of you taking a dump? Is something going on between the two of you? She could file sexual harassment but you should tell her that you can counter-file stating that she circulated a picture of you in a compromising position first.
What's good for the goose is good for the gander.

NO its not it didnt even happen to me and im pissed you should tell human resources what she did first and file complaint about her and you have witnesses who she showed this picture of you oh by the way what she did was invasion of privacy so you can do alot worse to her. Put that bittch in her place thats really messed up what she is doing you were just evening out what she did to you especially what she did was farr worse. Goodluck and I hope you get this straightened out

well.. do you have the picture to prove she did this to you? You have to show proof that she had a part in this sexual harrassment before the case would be thrown out. Otherwise it is just who gets to HR first and reports the sexual harrassment.

It was sexual harassment in both cases, but since she started it, she'll get more of the blame. Why would she do something that gross?

that is not SEXUAL harrasment is physical sexual bullying. if you didn't touch her in any inappropriate way then it can't be sexual harraseemnt, at least not in a court of law. you doing what you did she can't file clowning around as harrassement. they will take one look at her excuse and laugh it up. even if she does try something and it gets consdered there is 2 sides to every story you tell what she did to you and they will call it EVEN.

I think that she is very wrong. Maybe she is just bullsh****** about taking it to human resources. If she does take it look at the ***** like she is crazy and deny that its your ***. Who could know without implicating themself? Stay away from her in the future no matter how hard she pursues she sounds like trouble to me.
