I was in a 3 car accident. I was car #2. Car #1 was in front of me and car #3 was behind me. Car #3 hit me into Car#1. My insurance had lapsed without my knowledge due to a payment not received. So, due to me not having insurance Car #3 (Geico) said I'm not entitled to anything ( I did file a claim) for my damages and I have to pay 50% of the damage to Car #1. It doesn't seem fair. Oh, this happened in New Jersey. So is there anything I can do?

Ok, I'm going to tell you exactly why this has happened: there is a dispute. Someone is alleging you hit the vehicle in front of you first, then were rear-ended. When that happens the insurance company of the car behind you will only pay for your rear, no front damage, and will say that your injury (if you had one) was a result of your negligent act of rear-ending the vehicle in front of you.

So you need to find out what proof they have that you rear-ended the car in front of you first (unless there's a witness who saw it go down this way, or the car in front of you felt two impacts then they don't really have proof if you didn't admit that), and go from there.

Fault has no reference to whether you are insured or not. Geico is wrong. You did not cause the accident, Geico did. You should talk to a lawyer, unfortunately. They cost a lot. Car 3 should be paying for both your car and car 1. The fact that you didn't have insurance is illegal , but has nothing to do with the accident, nor the cause. That is dumb on Geico's part. Again you broke the law, but you breaking the law did not cause the accident.

You are a total douche for letting your insurance lapse, but I still think you have a leg to stand on. Let's just say you had insurance during this accident. It was still someone else's fault for causing the accident. If you had insurance you wouldn't be paying half. New Jersey may have funky laws, but it doesn't seem right.

Sorry dear but Yes you must pay up. Try to make sure that you make your insurance payments on time or set them up on-line so you don't forget. Good luck. It happens to the best of us and be thankful no one was hurt or oh boy big damages. Take care

yeah keep current on your insurance, your licence should be suspended for 6 months also, its the law to have insurance
