Is it illegal to establish a new credit file using and EIN number?

Well not only would it be illegal it also wouldn't work. An EIN # is an Employer Identification Number typically issued to use when you own your own business. A Social Security Number is what is used to create a credit file and the law requires that you use the one you are issued at birth.

It is done, but yes, it is illegal. Debts acquired in this manner can not be desolved in bankruptcy since it is considered fraud.
