... but i do not want us getting married first in brazil to effect us getting the fiance visa.... will this be a problem?????????

I am thankfull that every one took the time to answer my question but if I needed marrage advice i would have called doctor phill. I only asked about the visa not about the morality of brazilian woman. I have confermations from God about everything I do in life. Eu Amo Voce ;)

It's better if you get married in Brazil... it'll be easier to get the K2 visa to come over to the US and sponsor your new spouse, with the K1 where she comes as a fiancée, it'll be harder to convince the embassy that you really want to get married and that she isn't just using you to get to the US

it's also likely she could come here and you break up, then what.... if you're married, you must divorce and have to file paperwork they can watch, if you're not married, she can just leave and live illegally.

Either way, just have the wedding in Brazil, have your family come in from the US, take video, do the whole wedding dress thing, even if it's small, and submit that to the embassy, it'll be a lot easier to get married in Brazil, trust me... I've worked with INS.

ok this is right up my alley.
The fiance visa will work, but it is not as safe as the spousal visa.
The fiance visa, k-90 visa is based on her coming here for 90 days. During that 90 days you will have to marry or she will be sent back. The key to the fiance visa is for you to go there, have a party, take many photos to prove your legitimacy.
After the party, you file the papers. This will take 6-14 months. She will get an interview and they will ask her questions to prove its worth.
Honestly you should do what I did. I married my wife in Vietnam. Came home, filed the I-130 spousal visa form. It is much safer and the success rates are much higher. There is so much fraud with the k-90 fiance visa, they deny many many more then the spousal.
Why not marry her there out of respect to her and her family. Big deal, have a simple ceremony. And when she arrives here, go to your church and get it blessed and invite your family:)

dont use the fiance visa, trust me I know. mine failed and I lost 1 year of my life waiting. That is why we then did the spousal visa. The waiting time is shorter and rarely does it get denied.

If you get married, you cannot bring her here on a fiance visa. You will need to apply for immigration status as her sponsor. The fiance visa is usually the quickest. Talk to an immigration attorney to get the specifics of your case. If possible, make sure he/she has had experience dealing with the US embassy in Brazil or with cases similar to yours.

get married in Brazil file the I130 sponsorship for alien /relative for your wife as it now stands its about 6 Mo to the yr before it gets processed on the other hand if you file for the fiance visa upon the marriage ceremomy you can ask for an adjustment for her visa to permament residence i married in china and filed the 130 back in the sates and its been one yr now and no visa yet for my wife i checked with USCIS all the paperwork is right nothing pending but all the processing offices are behind schedules happy trails ps its not that complicated to get the fiancee visa just make sure you have all the evidence needed letters phone logs and your recent visits to brazil to meet the future MRS

McBrian told you the facts and he is right on target so follow his lead as I married a girl from the Philippines and lost a year because of the fiancee B,S then had to revert to the espousal visa and she will be here shortly , I hope

you can bring her here on a k-3 visa if you marry in Brazil or you can apply for a fiance visa and adjust status in the states. Good luck!!

If you just get married in Brazil, take the marriage license to the Embassy and file for her as your wife. It is actually less hassle. Good luck and happy marriage.

JUST an OPINION, but, One dude from Chilé told ME to marry an El Salvadoran gal THERE at the US EMBASSY. Then THAT will make things PEACHY EZ when she comes HERE to USA.
