It boggles my mind how ignorant people are on this subject.
If you are in the United States illegaly and you marry an american you get nothing. No rights, no priviledges. You have to have your spouse apply for a K3 visa which is a petition for a family member to live in the United STates, the only way for the petition to be valid is if the person is NOT in the United States at the time of application. If you are here as an F1 Student or on any work visa (H1 or L1) then you may apply for adjustment of status. But if you entered the United STates on a B2 visa or a Visa Waiver you cannot apply for adjustment of status.
Nobody is going to come and get you out of your home and deport you but don't plan on ever going back to your Country because upon reentry you will be deported.
I do this for a living so I know what I'm talking about.

How would he get the marriage license? He must have lied on the application and can be arrested and deported for fraud. If he leaves the country and gets married elsewhere he can come in as a spouse. If he is here on a student or tourist visa but working illegally and marries he might be able to stay because the marriage license applications don't ask employment info or at least they didn't used to.

No, the citizen will have to petition for their spouse who could receive a ten year vacation back it their home country. If an illegal wants to marry a citizen, they should do so in their own home country, then the citizen should return to the US and petition their spouse. That way they will be able to return in 6-8 weeks.

He can stay in the US after a long process of getting legal status. It will require several expenses, getting a lawyer, etc and being married and living with that person for a few years. You have to live with them and have joint bank accounts and everything. Be careful if you decide to do this illegal thing called marriage fraud, it might backfire on you.

it's not automatic citizenship. you have jump through hoops to prove it is a valid marriage....photos, proof of residency, etc... I have friend who recently went through this (from Russia) She was a Russian mail order bride, stayed married long enough to become US citizen then brought her Russian boyfriend over on student visa....now they are married. At least they both contribute our economy....send material goods home including cars, computers, etc.. I don't have a problem with that...it was all legal. And that is my biggest problem with the Mexicans and other Latino countries...they go about illegally and send the money back to their country...not into our economy! I feel bad for the people trying to cross at our southern border because having traveled to their countries, I would try to escape too! BUT....the law is the law and they are having negative effects on our country

sorry for the rant....hope there was an answer in there somewhere!!!

Not unless he has a green card which he can get from immigration. Marriage to an American does not enable a non-American to stay in US without the Green Card.
