I have been called alot of names by them...How can I make these people stop?

Wanna have some fun with them? This takes some guts.

Ask them to send you a copy of the contract signed by both parties evidencing that a contract exists and that you do rightfully owe them money.

Tell the person on the phone that you have no legitimate way of verifying that they are who they say they are, and that all correspondence must be in writing.

The reason they act tough and say crap over the phone is because they can - talk is cheap, ask them to put it in writing and then you have a clear paper trail of what is really happening.

You have several options. The first would be to be nice to them. They are simply doing their job. Many people who are in debt get angry and defensive, which results in creditors being rude to you. I am not saying it is your fault. And they should not be vulgar, as I believe that is against the fair debt collections practices act (perhaps you might want to do some additional research on this for your legal rights). I would suggest working with the creditors. If you explain your situation, chances are they can help you. They may be able to offer you a payment plan or something to help you get the debt paid off. If you are simply refusing to pay the debt, your best option would be to change your phone number to an unlisted one.

If they haven't reported you to a credit bureau make arrangements to pay it off. Check your credit report after making arrangements to pay off and before you actually start paying. Get your 3 free reports at:

If they haven't reported you and depending on how much you owe you can send them very small payments and they have to accept it no matter what they tell you. Do all correspondence via certified mail or email if applicable. Try to keep telephone calls to the bare minimum because it's there where they are experts. After knowing for certain they haven't reported you send them "good faith" payment after letting them know you plan on making payments (this will hold them off) If you owe $500.00 send them $10.00 a month. If you owe $5,000.00 send $30.00 or more a month and so on (you get the idea). DO NOT discuss ANYTHING with them other then the money owed and what YOU decide YOU will pay a month (Like how much money you make). Where you work or any other idle personal chatter).

If they have already reported you to ANY credit bureau, you don't feeling like paying them or you don't owe them money, do the following:

Send certified /return receipt letter to creditor telling them to Cease and Desist all further contact via postal mail, email, phone and any other contact. Works every time and it's the law. If they contact you within 3 days of them receiving certified letter with the words cease and desist you can use the money you win in a lawsuit to pay the bill and have enough to pay all the rest too....Letter MUST be CERTIFIED/RETURN RECEIPT mail (go to post office). Letter MUST include the words CEASE and DESIST.

Tell them they'll get their money when you have it to send. Not all people who can't pay their bills are deadbeats or think that they are special, crap happens that is beyond people's control. Creditors seem to not believe that, but the more that you work with them, the less crabby they are. I'd still report them for sinking so low as to call you names.

Wow, do these answers stink! Can you guess who the collection agents are in this mess???

Hey folks, why don't you even mention the fact that harrassment by collection agents is ILLEGAL! Quit excusing them!

OK, lets answer the question. Start by reading the link below. It describes what the collection agencies can and can not do, and what you can do to put a stop to it.

Start by sending them a Cease and Desist letter. Once they receive it, they are no longer able to contact you by mail or phone.

Next, send them a "demand to validate" letter. They have 30 days to send you copies of all contracts, bills, receipts, and everything they used to calculate what they claim you owe.

If they call you again, try to get a witness to listen in on the phone.

Violating the FDCA can result in your filing a lawsuit in small claims court, and you can easily win $1000 for your troubles.

Tell them that everything is in the hands of your creditors as you have filed for banktrupcy and you have nothing to say and that they will be in touch in due course

Well, is there a reason they would be calling you? They shouldn't still have any right to call you names. I would change my number or disconnect my landline and get a cell phone only.

Once you tell them, "Don't call me anymore", they're supposed to stop. I'd just let the answering machine screen 'em out.

pay what you owe, Businesses aren't around to lose money, they want their damn money that you some reason think you deserve to get for free.
