There was a minor accident with no police report, got a verbal agreement. I am willing to pay for the repair of the other car, but this person is giving my a hard time, she wants to take the car only to the dealer, which is very expensive, I have shown to her other 2 places, but she did not like them, what should I do?

We cannot take it to the insurance because there is not any police report and aditionally the person who was driving my car, she took my car without my permission

Report it to your insurance company - before she does. She has the right to get her car fixed anywhere she pleases, unfortunately, even expensive places. And she also has the right to report it to your insurance company even if you don't, and even if you had an 'agreement'. It would just look better for you to call first, explain the situation, and let them take over the claim from here.

This is what you pay for insurance for; let your company handle her and the hard time.

You do not need a police report to turn a claim in. A police report can assist insurance companies in resolving liability, but isn't necessary.

If this person was driving your car without permission, why are you offering to pay in the first place? You would have a valid defense if the other party came after you, as long as the non-permissive use was legit... not "she's driven my car lots of times but this time I said she couldn't go get cigarettes because I was mad at her."

I still say, report to the insurance company. You're in a lose/lose situation and the other person is holding all the cards.

You may want to call the body shop and explain that you are paying for it . Ask them if the estimate includes any "customer request" that means the owner may want a new fender when theirs could be repaired. Ask them if this is the best price they can do for you. You are really at the owners mercy. Many people get the "high " dealer estimate and then repair it cheaper somewheres else. You cannot control this. Ask the owner if it will be ok for you to pay the dealer direct when they take it in. You may be able to use your card to spreed the payment out. Also remember this is an estimate. It may be even more when the repairs are started and parts removed for inspection.

If you're paying out of pocket you have little control over where she gets it fixed or how much it costs. If you report it to your insurance they will look at her car and only pay the insurance estimate price for the repairs, because dealers jack up the prices. She can still get it fixed at a dealer, but they'll have to accept the insurance rate. She doesn't have to get it fixed where you want, and you're not very well protected if you pay out of pocket. I am not a fan of out of pocket settlements. They always backfire.

Talk to a lawyer. You may be able to have him write a letter to her and make her get 3 or 4 estimates including her dealer one. If she persists about you paying for the dealer estimate, I would let it go to small claims court. If she sues you, and you can provide her exact copies of the estimates, the judge may let you pay the estimate for the lowest or middle rate. Talk to a lawyer though.

She can take HER car anywher she likes. Do yourself a favor and let your insurance company handle this.
