Whether your son was somehow involved in the fight or not, assault is assault and it is prosecutable by law. However, if your son was an instigator of the fight or threw punches himself other than in self-defense, his parents can counter-claim and have your son charged as well. Do you have witnesses? Have you and the other child's parents spoken about what happened? Did you ask the principal's secretary to set you up an appointment on his calendar? The school should do something, 2-days is not that long as they have to investigate exactly what happened and who all was involved and to what extent. They can't just take your or your child's word for it. If the other child was the instigator and your child did not throw punches to start, then you have a criminal case. If your child was involved, you still have a civil lawsuit (small claims) against the other side but they may also have charges against you if your child hit theirs even in self-defense. Depending on your state you live in though, you may have to file against the kid for recovery of damages, the parents aren't always legally responsible. So then you would have to file papers to garnish his wages if and when he ever has any.

NO don't wait any longer for the principal to resolve this. A few years ago a similar incident happened with one of my sons and he was hit only one time before the football team rushed in and surrounded him shielding him from further attatck. We immediately took him to the E.R. and had xrays etc to make sure there wasn't any sort of hairline fracture or misalignment in his jaw. We then expressed our displeasure with the principal who tried to white wash the incident. We pursued on our own and the boy was arrested for a "battery". He received community service, a mandatory anger management course as well as a restraining order barring him and any of his family from approaching our son. They also had to pay restitution for our expenses and we declined any monies for therapy etc...
We sent a harsh message to that child and his friends that if they infringe on our son's personal space we were coming after their parent's wallets.
We also had the option of having that student removed from the High School and sent to another school. We declined that as well . That boy never bothered us again. Little did he know that my husband is Fed.Law Enforcement. The school got a mean education too because they weren't aware that we knew what we were doing. Don't let too much time pass by.
Contact the D.A.'s office or a victims advocacy agency. Also, you can't just file a report with the police tell them that you want to file battery charges.
This is different than "assault". The prosecuter's office will send you paper work. Your son may be given an opportunity as mine was to write a statement and a letter to the judge telling him how the incident has affected him. My son wasn't required to be present during the trial they used his statements. Also make copies of all the medical reports etc...
Take a copy of the medical report to the school personally. Hand a copy to the principal. Demand to know what is going to be done. If they have a school resource officer then this officer should already have begun an investigation.
Make sure that you have photographs of all his injuries. Circle and identify them etc...
Move quickly or the boy that attacked your son will soon be contriving excuses for his behavior putting the blame on your son.
Good Luck!

Get a restraining order from the cops, and consult a lawyer . And tell your son that the idiots who stand around gawking at a fight often end up part of it. He does have some responsibility in this, you know. It's not like he was held hostage or something... He could have walked away or sought help for the other kid getting beaten up.
No wonder the principal doesn't call back.

Call the School District and file a complaint for the school not responding to you.
You can sue the parents of the boy in civil court for medical expenses; you don't need to involve or go through the school system to do this. Get an attorney and have him work with the doctor treating your son to determine damages.
Suing the School district isn't likely to get anywhere, but you can try.

i pray to God you son not in any respect reads this. And in the destiny, it could be incorrect. They did a documentary on discovery well being the position this physician were given twin boys and has the moms and dads boost one as a boy and the different as a lady. in the course of the boy's(female one) existence he idea there develop into some thing incorrect with him and he couldn't fit in. even as he develop into about 14 they tell him he's truly a boy and he starts branching out. properly, his twin brother who develop into the well-loved individual son, began occurring hill. Why? because he develop into now no longer the in elementary words son. some ordinary years down the line, the guy who develop into raised as a boy killed himself. A twelve months after that the guy who's raised as a lady commited suicide also. So no one wins.

If you can afford to, hire a lawyer. If your son was truly innocent then I would fight for his rights. The boy who assaulted your son should've been arrested for assault. I would definitely contact the school board and if they don't help you out, contact the local newspaper or news station. I'm sure they would be interested to know that the school board & principal aren't doing their job.

I would go and stand in front of the principal's office until he decides to talk to me, if not go to the school district and file a report or talk to whoever i need to talk to so they do something about it, and about the principal too, and make sure you take pictures of your son so you have evidence.
