my father was killed by a semi while changing a tire 3 yrs ago. my mother has a trial date ot 10-17. i found out on 9-22 that the man that killed my father is an illegal immigrant and is now driving again for the same company. i have asked my mothers attorneys why they are not pushing the illegal immigration thing and they say it is irrelevant. if you ask me IT IS relevent. If Kazimierz A. Kusnierz would have stayed in Poland where he is from , he would not have been in America where he killed my father. Andf now he is behinf the wheel of a semi truck again. I think because I live in a very small town my moms attorneys are afraid to go after the government. Does anyone feel that the government should be liable for my fathers death? I only ask b/c I feel since noone here knows me you all would be the jury so this opinio really matters before i go on. I have 19 days left. Do I get my own attorneys? As far as the geek i need to no how to find out how to get all the info on this guy i can

I am very sorry for what happened to your father. However, anyone could have been driving that truck. The company who hired him could be held responsible for hiring an illegal immigrant who maybe had poor training. And the man himself should be held responsible. But the government is not responsible for the actions of individual people. If they knew he was here illegally he should have been deported, but if they didn't know he was here they can't be held responsible.

The government is at no fault for your Father's death. Anybody could have killed your father the same way, immigrant or not. We're all immigrants anyways. It is not correct that he is driving again with the same company!!! He should be behind bars because he himself (not because he is an immigrant) is responsible for your Father's Death.

It is NOT relevant. Think about it...if your father's ancestors would not have move to America, your father would not have been in America were he got killed.

I understand that Colorado is asking their attorney general to sue the government to get funds for incarcerating and educating illegals based on the idea that if the Federal Govt had enforced the laws the illegals would not be here.

The difference is that even if Colorado loses the case, they win in making the Federal Government's failure publicly apparent. In your case, if you lose (and you can only sue the government on specific grounds) you would be out a lot of money.

Philosophically I am totally in favor of your suing the federal government. If it were my money, though, unless I was willing to spend it just to make a public statement, I am not sure I would do it. Make your mother's attorneys run through why they would not sue the federal government, and LISTON to them before you make up your mind.

Best of luck, and I do agree that the federal government is at fault. I just don't want you to throw away family money when you have already been hit by such a loss.

Wow - I know you offered a lot of useful information and I'm really not sure where to sort it all out.
Still, you hit the right note: get your own attorney.
There are some damn good legal eagles who could take your case pro bono and go after the man who killed your father.

Still, need more facts to sort out the dynamics, but it sounds to me as if you have a case.
You might also contact the U.S. Immigration Dept. for legal advice...but don't hold your breath waiting for an answer...any gov't. dept. is painfully slow in responding.

First, I'm very sorry to hear about your dad! If this person is illegal, it should be part of the problem. I agree, if he was in his country, your dad would still be alive! I say, sue the government, show them that the laws aren't being followed and someone needs to do something about it!!!!! If you need a petition signed let me know! GOOD LUCK!

First I'm sorry for your loss,and i agree with you, this guy is illegal don't no body no what that word means,if he wasn't here he would never have kill your father,now the rest is up to you,this country is a Republic,which means we have representatives,run to yours,explain every thing to him don't leave anything out,if he says he can't help you,inform him you are going to the local news paper or services,and do it.

I definitely think it is relevant. He needs to be deported, but at the very least, he should have lost his job driving a truck. I don't think the government is liable for your father's death, but their actions after it happened aren't right.

I think you would have to prove the company knew he was illegal. Don't know much about law but look in the phone book in your area, call & run it by them - act like you are "shopping" for an attorney......then call ICE & tell them your story, be sure & get a name or #, then call your senators office, tell them who you talked to & ask for their help in deporting this criminal!

I feel for you such a tragedy I think you can sue the government and you can sure as Hell sue the company that hired the man who hit your dad. You can also sue the man.
