I believe such a thing violates the constitutional rights of the students.

I'm not opposed to drug testing for students who want to be involved in extracarricular activities, but not random mandatory testing for all.

Even if there were no ethical or legal issues with such a policy, drug tests do not conclusively prove you've taken drugs. If the school takes action against a student for failing such a test, they are then guilty of violating the due process clause in addition to the privacy clause.

It would make more sense just to decriminalize drugs.

This issue was decided by the U.S. Supreme Court in June, 2002. The Court upheld a school's right to perform random drug tests as a way of ridding its campus of drug users. Further, the Court upheld a lower court's ruling that this does not constitute a violation of privacy, nor does it violate search and seizure laws.

My feeling, though, is that schools should do these tests uniformly, or not do them at all. Many schools were testing students who participated in extracurricular activities only, which seems arbitrary, capricious and discriminatory to me.

When I was in high school, this would have strictly been the role of a parent. Nowadays, though, we see courts increasing schools' "in loco parentis" rights, which does make me uncomfortable. Today, it's random drug tests and mandatory schooling about homosexuality (per laws recently passed in CA); tomorrow, it may be something much more objectionable to parents, unless we do something NOW.

I have no problem with drug testing in schools, but this is probably because I know my kids don't take drugs.

Horrible! I think drug testing, random or otherwise, is an invasion of privacy and should only be done (either kind) for jobs where public safety is at risk, such as school bus drivers. Or just plain bus drivers.

Certainly there are good arguments for it. However, there are also good arguments for enforced sterilization and other intrusive things. We do not need any more governmental parental rulings!

For the record, I am not a drug user. Ok, I experimented in my teens, but it's lonnnnng out of my system!

I'm totally against it. That is something that should be between the parents and the child. I know my son would flat out refuse to take a drug test given by the school. He would also fight not to have his locker searched or his back pack. They go to school for an education not to be policed. Wow, I think I made my kid sound like he has something to hide but the truth is he should have a right to his privacy. If they suspect my son of doing drugs or selling drugs then they can call me or contact the authorities.

Is it considered probable cause to drug test a student if another student has accused them of selling or taking drugs to the school admin?

should be done.
however, students do have rights... whether or not students are exempt from random drug testing, I cannot say, but searches can be conducted without the student's say, and no violation of rights there.

Personally, I lean to the Right. Strong military, right to bear
arms, financial responsiblity from government, less government
control in our lives. But Republicans have had power too long, and they are force feeding morality on us.

That would be a big invasion of privacy issue. And I think it would show that the U.S. is becoming nazified. But on the other hand If they are a problem student I think they should test them and if they fail then they should be expelled.

It should be done not just on students playing sports but everyone. They have random drug searches, why not random drug testing.

Absolutely not. It is none of the school's concern (nor is it an employer's for that matter). I am WAY BIG on privacy issues.
