In 1981, the Refugee Act was passed. Asylum and/or Refugee Status was to be granted to anyone outside of his or her own country of Nationality (or already in the US) who is "unable or unwilling to return because of persecution or a well-founded fear of persecution on account of race, religion, nationality, membership in a particular social group, or political opinion".

Difference between Refugee Status and Political Asylum: Both refugees and asylees must fall under this category. The most important difference is that the Refugee status application is done outside the applicant's home country as opposed to the Asylee who can apply while in the US.



Who Can Apply?You must be applying for political asylum based on an actual experience of persecution in your home country or fear of persecution based on race, religion, or political opinion.
If you are physically present within the US, you must apply for asylum within one year, unless you can prove that extraordinary circumstances kept you from applying within that year. Otherwise, you may apply upon entering the United States.
You may apply for political asylum even if you are illegally in the US.
You may not qualify for political asylum if you have participated in the persecution of others or if you have "firmly resettled" in a country other than your home country. Firmly resettled means you have obtained permanent residency in a country other than your home country or the US.
If you meet the qualifications, you may be approved for political asylum unless the USCIS proves that conditions have substantially improved in your home country.

Political Asylum allows you to stay and work in the US temporarily. An asylum seeker may ask for Derivative Status for his or her spouse and children.

There is no quota limit on the number of people who may obtain political asylum, however, there is an annual limit of 10,000 on the number of people who may obtain permanent residency based on political asylum.

It is very difficult to get refugee status to come to the U.S. If your wife's mother or sister are US citizens, they can sponsor a green card for your your wife (and you and the child) to come to the U.S. Although this may take a few years, this is your best chance of staying in the U.S. Most likely, you will not be granted refugee status and the immigration officials can put you and your family into custody, pending your deportation. You should not risk that, especially with a young child.

In the alternative, if you are an engineer you can get an H1-B visa which is a work visa, if you can find a US company to sponsor you. If either you or your wife got an H1-B visa, the other spouse and child can come as well. After 2 or 3 years on the H1-B visa, you could apply to become a permanent resident and get a green card. This would be the fastest way.

I'm not sure of the process, since it is a prolonged and difficult one. Are you Chaldean or Assyrian, possibly Armenian? I sympathizes with you for leaving a worn torn country, filled with insurgents who wish to destroy any forms of freedom--including religious freedoms for Christians. May God be with you and your family, and guide you and fellow Christians from Iraq to safety.

Make sure you get your status in Turkey as refugees and register with UNHCR there. UNHCR refers cases for re-settlement such as to the US and other countries. So it is up to them to refer you to the US govt for consideration, after which you will undergo an interview and assessment as well as thorough security checks and background checks.

why hasn't the mother sponsored her daughter to the USA welcome if they grant you entry
