i work on an aboriginal reserve in north east saskatchewan. I signed a contract that states that i would work 10 months a year and have june july and part of august as my days off. I recieve pay for the whole year. Our administration follows the provincial salary guidelines. The problem that i'm experiencing is that they pro rate my salary. What i understand is that if l leave work for a day or two weeks then they adjust my salary to a lower pay scale since i was not there for those days. Is this legal and if not what can i do..?

The fact that this is a contract might -- repeat MIGHT -- make this a special case.

If it was a conventional staff position, hired by the band, then the band likely would be required to give you a certain number of days as holiday time, in accordance with provincial legislation.

But because it's a contract position, the terms of employment are pretty well laid out in the signed agreement. If a provision lets the band deduct pay for days when you're not there, then you're kinda stuck if you signed it.

A lawyermight be able to shed more light.

Of course it is.
We do it here in the States,
I'm salary but I have to work at
least 27 hours a week.
