The child needs to be sitting on a toddler car seat if he/she is under the age and weight requirement. All adults need to be sitting comfortably in a seat with a seatbelt. Be aware of policemen when you drive around. If the car only fits 8 passengers safely and you have 9 people, it will break the insurance coverage. If you're lucky, you won't get caught. Usually, in California, the police won't pull you over unless you're driving under the influence, speeding, don't stop at a stop sign, illegal u-turn, no seatbelt on, and no car seat for babies and toddlers. As for Vegas, if you're planning to stay on the strip, you could just walk. There are a lot of people there, so there maybe a lot policemen driving down the strip, so be careful.

You'll be OK. If you have full coverage (liability, collision, comprehensive),your insurance covers rental cars.. in fact any and all cars you drive are protected by your personal coverage.

As to the passengers, one will not have a seat belt. Although its not safe, I don't think there are any laws in California or Nevada that require seat belts for adults in the back..

Make sure the five year old has one of them.
