About Capquest Debt Recovery?

Does anyone know if debt recovery agencies are allowed to phone us on Sundays?

I am having dealings with Capquest at the moment. These people are rude agressive and they also phone on Sundays. (hence the question)

I have had enough already, I have given Direct Debit arrangements to them, but there was a hiccup at my bank..Capquest were on the phone again ....I ignored the phone for a while...then I found the phone number..not the 0870 number (You can get a normal one off their website) I then phoned them and spoke to a woman on the phone. She was trying to tell me what to pay. I just said..."Excuse me, I have already made an arrangement and that is the one I will adhere to" ...It did the trick.

I would like to hear form anyone else if they have expereinced the same thing.

Yes they are allowed to phone on a Sunday. If they restricted their calls to office hours they would not find many people in. So they call evenings and weekends.

What they are not allowed to do is harass you. This can cover calling multiple times in a short period (say, five times in an evening) or being overly rude and aggressive. This latter might prove difficult to prove as it would be your word against them.

If you feel they have overstepped the line then report them to the Office of Fair Trading who do take these complaints seriously.

Truth is these people have very little leverage legally.

You are perfectly within your rights to put the phone down on them, given that you have agreed an arrangement.

I'd say it's well worth using debt counselling charities such as CAP (Christians Against Poverty) who can stand in the gap; help budget and negotiate with these people.

Bankruptcy is, of course, an option...but it comes at a heavy cost to your ability to borrow for many years.

Yes they can phone on a Sunday. Some debt collectors can be rude. What you have to do is look at it from their point of view. They have to call people who are constantly rude to them and won't take responsibility for the money they have already spent and signed a contract against. Half the time these so called poor people get paid more then debt collectors and just decide to be lazy.

As you said there was a hiccup at your bank, therefore your mistake. The lady on the end of the had ever5y right to demand what payment you have to pay. You defaulted on your repayments before you had even started. Look at how it must of looked from their point of view. They are so prone to be lied to that they will automatically think you are guilty and you have to prove you innocence.

I dont know if they are allowed, but those people will stop at nothing. They some how found my work number and were calling me twice a day at my work, which was a total nightmare!

i have heard these debt recovery agents will stop at nothing and it surprises me how they can get away with being so arrogant
