His sister ran away about 5 years ago and he recently found her on the internet. It turns out she is in jail and has two kids. They have been in foster care for about a year. we want to get the kids out of foster care and take them. i understand that ehy are going to a criminal back ground check and whatnot, and thats fine and all, but what does all this consist of? what else will they be looking at/for?

In the criminal background check, they will look at ALL possible past offenses. The other things they will require is a certain square footage amount for both kids (personal area) and also if you are certified in CPR, etc.
At least, that is what they do for Foster parents here in Mid Cali.

They will do SEVERAL inspections to your home, checking for things like safety issues, (you can't have a pool) cleanliness (not immaculate, just neat and clean), and you have to be able to provide adequate living space for each child, such as a bed for each child, over a certain age, and/or each gender, and you may have to take parenting classes. I know that if you are just looking to be foster parents, it's a long drawn out process, and takes six months at least, but I think it's not as strict for family members, but there are still standards. Good luck, though, what you're doing is a great thing.

I have seen this many times before. First you have to get her to give consent to give them to you ,so that you have custody. Doesn't mean she has to let you adopt. Just as long as she is in, or what ever terms you come up with. Then you get into contact with CPS...they will locate the children and find out the situation they are in....hopefully they are not in adoption stage. But you will have to make sure you meet an income median. There are many lawyers(family) that can help you draw up the paper work for her to sign. Talk to your local wel-fare office and they will lead you in the right way. With your husband being close relative...you may not have a hard time at all. But just call the people I have mentioned...and it shouldn't be too long.

Depending on the country you live in if in Australia then put your case forward are you happy in your relationship. Can you give the love support and home these children need. You may only need the mothers permission but you both will need all the local and state checks. The depts will be only too pleased to place children in caring loving family homes. You must both be prepared for the parenting roles it is not easy but good luck to both of you. You both are very special to take this on.

You will probably have to go through parenting classes and be subject to spot checks from your local child services for a while. Other than that they should be more than happy to get things moving as it will mean there are two less kids in the system.
