my father n law is in the hospital w/ heart failure the care he is recieving is minimal at best.Can we take him to a better facility ? he should have been released today but,he keeps taking downward spirals and the Dr. has done nothing to help him . Matter of fact he forgot to order his breathing treatments that he has been taking for well over a year which caused him to have a severe anxiety attack due simply to the fact that he could not breathe.Now this same DR.(????) says he will be good to go in 2 days and all we need to do is go pull up his carpet and things will be alright.We can see that he is not improving and that he needs better medical treatment than he is recieving , Any answers or directions to a place that can provide some answers would be greatly appreciated...

If he's considered "of sound mind" then he can check himself out anytime he wants to. I assume he's not a prisoner either so all you have to do is make preparations with the place that you are going to take him to. Then get him dressed and the entire group of you walk out.
It would probably be best if he signed a release for the hospital but he can do that in advance of your arrival.
If you have any questions you could consult an attorney who knows something about veterans affairs and find out the best procedure. However, don't wait so long that he dies before you get him into the facility that you prefer.

Well you can transfer him where ever you want. The question will be who will pay the costs.

Does your FIL have any other medical insurance, you must look at his options. Medicare?
