Arrest is valid even when you are in the back seat as long as there is possession.

It's really, REALLY important who you hang out with. If you're in a car, in the back seat, and the driver decides to do a drive by shooting, you better believe you're going to get arrested.
Even if you are telling us the whole story, yes, you can be arrested. My advice - get new friends and research the law and know any possible rights you may have. Don't trust the attorneys.

well you were an accessory..you should know the people you hang out with and their habits. being charged with possession is a misd. and usually they look at your age and your past record.. you could get a prayer for judgement, probation (supv or unsupv) and possibly community service. Some judges may order you to attend rehab/counseling and then if you pass that may dismiss the charges. If I had a clean record, I would def hire an attorney

Get a lawyer if you can afford one.
Cause the court will appoint one for you unless you cop a plea bargain (thru DA office) or plead quilty.
The court believes this: You were charged and apparently by legally facts. Birds of a feather flock together. Run with bad company-expect to be considered bad company.
If you don't have a record, I would hire an attorney to keep my record clean.
If you got a record you should have known better than get busted.
Deal with the consequences or pay to fight it.

In the U.S. it's anyone and everyone in the car can be charged !
I had to force this issue down teens throats so they would understand it. Don't ride with or give rides , unless you want to take a chance on being charged. I agree it's unfair because you don't know what others do behind closed doors.

And you had not idea the people in front had drugs?? You need to mention that you were in the back seat? You need to mention that you had your seat belt on?
Intent to deliver?? Did they think that you were going to deliver with your SEAT belt on? There is more to this story than you are letting on...puh-leeze--sign back on and let us know...THE REST OF THE Story and we can intelligently answer, hon....

so what is your question? and what does it matter front seat or back? possession with intent means you must have had a certain amount of something or else it was packaged in a way that made it appear that you were selling it

Where was the contraband? What state were you in? In many states, all in the car can be charged with possesion, for anything in the car- If you were truely innocent- you may want to find some new friends to ride with

If it was on your person and the wieght of the drugs in question exceeded what the specific State lists as "distribution weight" (i.e., more than is considered feasible for personal consumption), ...yup. Doesn't matter where you were sitting. Doesn't even matter if the **** was yours, ...what DOES matter was if you had CONTROL of it when you were arrested and how MUCH of it there is. Happy Trails!

In many states if it is in the car, everyone in the car can be charged. Sounds like time to make a deal to testify against the perosn who it belongs to
