As far as I know, it's still illegal. People were getting sick and dying from the wormwood in improperly made absinthe, so it was banned for that reason.

"According to U.S. Customs and Border Protection, "The importation of Absinthe and any other liquors or liqueurs that contain Artemisia absinthium is prohibited."[25] This runs contrary to FDA regulations, which allow Artemisia species in foods or beverages, but those that contain Artemisia species, white cedar, oak moss, tansy or Yarrow, must be thujone free.[26] Other herbs that contain thujone have no restrictions. For example, sage and sage oil (which can be almost 50% thujone[20]) are on the FDA's list of substances generally recognized as safe."

Importation is banned, which is slightly different from being illegal. Although you are not allowed to import it, if caught it will only be confiscated, since it is not a controlled substance no one has been finned and it is not illegal to own.
Ironically some people who try to hide it in fake containers or the like when bringing it home on a plane are doing something much more illegal than actually bringing in absinthe.

Yes,it is still illegal to import or sell any alcoholic beverage containing wormwood in the United States. On the U.S. Customs Service’s list of items that tourists traveling abroad must not even think about importing, absinthe is prominently mentioned—right up there with Cuban cigars.
It sucks but it is the law.

Yes it is Illegal to import it, However, I don't think that it is illegal to make your own here. Strange but true. I think you need an liqueur making license.
