On Sunday, myself, husband, 3 children and our dog visited a local petstore. We tried a dog sweater on our basset and it was too small so i told the kids we would look somewhere else another time, so we left and went to lunch. 2 hours later an officer shows up in front of our house, i was at a baby shower at the time. The officer handcuffed my husband in front of my kids and told him he was a lying theft and that he knew he stole a dog sweater from this petstore. My husband of course denying these unbelievable accusations.All the while, my 10 yr old daughter crying her eyes out watching her stepdad in front of a squad car in handcuffs for 20 minutes with neighbors watching.Since there were children at home he had to let him go and gave him an order to appear in court.The next day i called demanding to speak to the officer and got no call back so i talked to another officer and he went to the store to watch the video and called me and said nothing on the tape is readable.

If you really want to talk with the officer who so ignorantly came to your house keep going to the police station until he is there, or try asking for a meeting with the chief and tell him the concerns you have with the manner of the police officer who came to your house. Contact a lawyer and have him with to help with the case he should let you know what you can do. Also if you have a local paper and the police station won't help see if you can write and article about the unprofessional ism of the police department and the store owner.

Understand that the officer did not have to let your husband go. He made the choice. Just because the kids are home does not negate me taking you to jail. It's a shoplifting charge which is pretty low on the list of bad things. Your husband was issued a ticket. Basically, he was arrested and released on his own recognizance. Very typical. Regarding the situation, I would first contact the store manager and ask what happened. They are the ones that contacted the police. Next I would request a copy of the police report and see who said what. Then I would contact the prosecutor's office and politely ask to speak with the prosecutor regarding the circumstances. Remember, the police file the charge but the prosecutor takes you to court. He's the one you want. If it turns out that the store was wrong, I would pick up the phone book and find an attorney. The store manager should not be filing charges against you without evidence. They are liable. Good luck.

You didn't say that you took the sweater off the dog... which I'm guessing you did, because they would be totally right if you didn't!
Only if there is a tape of you walking out of the store with it, they should have had somebody stop you before you left the store then. I don't understand how they can go back later. How did they even know where you live? I think you are leaving out some other details.

Did you take the sweater off the dog and put it back on the shelf? They should have stopeed you before you left the store and searched you not hours later at your house. thats really weird that they could do that. I would say if there is no proof and they didnt catch you in the act and they have no tape of you leaving the store with it, you will be ok.

Just because he was arrested does not mean he will be convicted. How did the pet store employee know who you were, and know to call the police unless your kids took the sweater home with them. (It is a possibility) I think you should try to talk to the arresting officer and his supervisor before you sue. Also talk to your kids to see what happened, and if maybe they had it in their hands when they walked out not noticing.

If you spoke with another officer who wasn't the Investigating officer DONT go by what they say, they weren't involved from the begining.

Look the answer is really obvious....
You tried the sweater on the dog, then YOU decided you didn't want it! Did you ask your dog? No you didn't did you? Obviously the dog went back in there and took the sweater, he liked it!
To be fair to you, if you dress up your pets in sweaters you need locking up.
