No, if the petals are attached to pistil or gynoecium then they are attached below the "pistil". More often the petals are attached to the gynoecium.

the pistil (or the carpel(s)) is actually joined to the peduncle. if the flower is blooming, the petals are merely wrapped around the pistil and the stamen. as the flower opens...

Fusion of petals is called gamopetalous.If they are joined ,the carpels need not be attached to them.
