For people, it would probably be seen as a violation of your fourth amendment rights, freedom from unreasonable search and seizure. Unless you have probable cause to use such a device, possibly people who may flee after posting bail or level three sex offenders, there is clear violation of this right and even with some of these afore mentioned reasons, it may not be constitutional to use such a device.

I have one in my dog and he's never complained, plus I can find him if he gets lost and anyone finding him gets access to his medical records.
