Say your brother quit dating her and got back with his wife and then you started dating her:
1. you have someone that your brother already had
2. your brother will be pissed
3. His wife will be uncomfortable if not pissed
4. You will always wonder when they are together at family things if something is going on.
Leave her alone, you don't want to get in the middle of all that, it will cause a problem with your family and blood is thicker than water.

Tell her how you feel. Tell your brother how you feel. Be honest with everyone and see what happens. If she doesn't feel the same way, then you can just move on anyway.
I would talk to your brother first though and make sure he's ok with you saying this to her.
Ultimatly tho, find your own chick. It's kinda gross to take your Bro's sloppy seconds and it's uncomfortable for everyone.
