The police will come and try to determine what the odor is. If the officer believes it is just a nuisance odor like rotting garbage or poor hygiene issues it will be up to the landlord to do something about it. If however he believes it could be dangerous (gas or other explosive smell) or a result of a crime or adverse situation (dead body smell) he can have the landlord open the door to check. Otherwise it is up to the landlord. If he refuses to take action to eliminate the odor you may want to consider moving. Most landlords will then decide who is the better tenant.

1. your landlord has a right to enter the property and can do so himself.
If the police come and smell the order, they will have to get a warrant to search the house( they can ask them to let them look but they don't have to)
Or of course you and your neighbor can go and tell them that you are getting sick from the smell and that you are calling the police and going to video anyone comming in or out of the house. If they are doing drugs they will either kill you or move.

They will need a search warrant or permission to come into the apartment. However, there are certain situations when law enforcement may enter without a warrant, If minor children are in the apartment with the suspected drug activity, you can file a report with child protection/ children's services. Law enforcement will almost always accompany the social worker when they initiate the investigation. They do not need a search warrant if a child is in danger. Either way, if a child is present in a dangerous situation, this should be reported to child protective services.

Why call the police ? Call the FIRE DEPARTMENT... report smells of probable hazardous materials, the fire department can enter for public safety.
I'm assuming your smelling something other than some weed burning... chemical odors from a meth-lab ?
The police can get a VERY quick warrant if they have probable cause... and CAN enter without a warrant if there is danger or threat.

If you called the police they wouldn't be able to just enter at will. They must have an order to enter. The only thing that they could do is put up surveillance and eventually get a warrant. Of course if they realize there is something going on they could get the warrant sooner.

I think they would have to get a search warrant. then they can search the apartment . If it is making people sick I would want it checked out. I would report it to the police and tell the landlord that you did so. Good Luck Hope you get to the bottom of your problem and stay healthy. God bless.

The police are not allowed to enter a residence unless they have a search warrant. They can ask permission and if they are denied
They may investigate if they believe there is
something suspicious and obtain a warrant to search the premises.

They knock on the door if someone answers and they smell the odor then they can proceed in other wise there would have to be a strong suspicion for the police to obtain a court order to enter.

if you cal the police in to this hons they the police must have probable causes here hons they cant just act on something you have beeen snifing, our suggestion is and e think you do have a problemm here hons is have the cops set up a undrcoveer agent first sighs are there a lot of people coming going and lleaving and hopping in cars realy fast hons?? go too the police de[partment with your suspicions, and talk to a detective not some pe on oficer who could just laugh at you hons, and ask for a undercover oficer too infiltrate, and if you have a cordles phone, they might have monotoeing devices like another cordless phone were they can pick up on your conversations hons be careful hons go to the p.d.!!!1

Well it all depends on what state you are in and also the circumstances...I mean, hypothetically if someone were to call anonymously and say that they saw someone being beaten up and then taken into that apartment or whatever...then the police may have means to go in there...not kick in the door.
But there are certain circumstances in which police can enter places without consent...It's all circumstantial though and it depends on the laws in your state.
