Lien through GMAC, it is in dad's name. We live in Louisiana. Local dealership(which have known dad for 30 yrs.) let dad sign a credit life insurance(which they knew and dad knew) that it could be fraud(policy asks about illnesses), my dad had all of them. But dad paid $2220.00 for policy(suppose to be if died, would pay off vehicle(GMAC beneficiary). Now after death, credit life sent papers wanting medical history. We knew he wouldn't pass, mom went to GMAC and signed paper work for the $2220.00 to be put towards monthly payments. We have a lawyer, but is it too late to do anything. They took his money without any problems, now that he's dead we're the one's going through hell.

well sounds like your mom signed papers so now Its gonna be on her more than likely. Hope you win but it doesnt sound good.

If the policy was to pay off the vehicle with GMAC as beneficiary the vehicle belongs to GMAC, but that doesn't sound right if payments had been made towards the vehicle, i.e. your Mom should have some equity in the vehicle. As for the policy being deemed fraudulent, GMAC accepted the policy and received payment so the policy is valid. However, if your Dad misrepresented his condition on the application, the policy could be deemed null and void. Its possible you could recoup the $2220.00 paid for the policy.

Your attorney should be able to competently handle the matter. Sometimes "patience" can be tough when resolving these issues.

Sorry to hear of his passing. The whole thing not haveing the car or truck in both of there names on the title paperwork. The truck should have been paid for if the life insurance policy was in effect. Or the Dealer just took his money. Sold insurance to get a interest rate. Like paying down points on a home mortgage. I suppose they really like his money and did not value his loyality. Make sure you hire a will and probate attorney to straighten out all of the property the best way.
