it depends on laws--first is it legal for you to be on the phone while driving? 2nd, was there a bike lane? if not, was he in his own lane keeping with the flow of traffic? if so, then there is no fault on your part .. if he was riding in a lane, with the flow, or speed limit, then he has to obey the same laws as a person driving a car. But either way, if he was riding a bicycle 40 mph and he wasn't paying attention to the road and vehicles ahead of him, then he is at fault--it wouldn't matter if you were on a phone, or a big breasted woman wearing a bikini while driving--fact is he was paying attention to you, not where he was going--but my opinion in no way condones you driving while on a cell--that is wrong and should be a law in all states--i lost a very close cousin to a driver on a cell phone who was trying to redial a number when a signal was lost, and didnt see the stop sign or my cousin walking legally in the crosswalk and plowed into her at 45 mph.....and is currently walking the streets a free person prolly still on the fu**ing phone in her car---however the law works for the criminal in some cases, and if your story is completely true then it looks like the law will work for your sorry a** too....

What in your pathetic life is so important that you need to be yakking on the phone endangering everyone around you? If it was really important you could have pulled over and talked on the phone. Idiots talking on cell phones while driving are a threat to society. I hope he sues the hell out of you.

Never ever drive near a pedestrian (a person riding a bike is considered a pedestrian) , why would you even drive near the poor guy?( good reception is not an excuse). They always have the right of way. 40 miles per hour is fast. I think the court will be on his side. -you are using your phone while you are driving, and you didnt give a bigger distance allowance for the messenger.

was there a bicycle lane? what are the laws where you live about cell phones? what are the laws about bikes ont he road? if you were going 40 mph and he could keep up -- he might have been the one riding reckelssly.
personally i would be discussing business while driving - it is distracting to your driving, no matter how much you think it isn't.

If it's against the law to do that in your area, you're screwed. I think the bicyclist was freaked out by seeing that, because it is one of the leading causes of accidents nowadays. That, unfortunately, caused hm to have an accident of his own. Technically, you weren't at fault, but being on the phone while driving...

i'm 13 and that i've got had a cell telephone considering that 4th grade (age 9). I do think of that it rather is mandatory to have a telephone while you're in a subject the place the two certainly one of your mum and dad paintings, like me. My mom initially have been given me a telephone on the age of 9 for emergencies and because the two certainly one of my mum and dad paintings. i think of that having a cell telephone as a newborn is important presently, however the extra issues that youngsters do like severe texting and social media are surely no longer mandatory.

Sorry to say this but you were totally and completely wrong to involve this rider in your business deal. How rude. How self centered. How scary for this person to be hounded by a moving vehicle to the point of having an accident. You should be ashamed of yourself. What if it was someone you cared about that was being followed like that (wife, girlfriend, brother, sister, child, etc)? Would you think it was an ok thing for someone else to do to them? Think about it, and maybe you will see that your were totally inappropriate. Take your losses and learn a valuable lesson from it.

Just to let you know...it is considered wreckless driving if you are talking on the phone while driving. How is it possible for a bicycle messenger to be going 40 mph anyways? You should have common sense, your just forgetting to use it.

You should have pulled over to the side of the road and made your deal parked and safe rather than making a bike messanger nervous enough to worry more about you and your driving than the parked car in front of him.
