we signed a contract in june for the contractor to remodel our bathrooms, kitchen and install hardwood floors in bedroom. the total was 12 grand..for labor..we were supposed to pay 6 grand upfront and the two grand once each of he project was finished. well he finished the hardwood and bathrooms (the bathroom has small stuff remaining though) and he hasnt done anything with kitchen. we have paid him 10 grand..for two weeks he hasnt picked up the calls or come to work. he has done this before and we are fed up..he said its supposed to be over in a month, its been almost 3 months. he has taken 3.5 grand more than he's supposed to have (compared to work done) what do we do??

Aside from what everyone else has told you, make sure you demand lien waivers from this contractor...and don't rest until you have them! If he has not paid his suppliers or subcontractors, or even his employees, they could file mechanic's liens on your property and force you to pay them in his stead, since your house has their materials or used their labor.
Be very sure you have lien waivers from this contractor, being without them is very costly.

First of all, never use a contractor that wants money up front, Giving them draws at certain stages of the work is doable as long as you make sure you are still ahead when you give him the draw. I've told this story so many times because people just don't understand that there are so many crooks in the construction business. Depending on where you live will depend on what can be done about it. I live in Ohio, and here, when a contractor does this sort of thing they can charge him with whats called "theft by deception". What this means is that he decieved you into believing he would complete the work so you would give him money. In Ohio this offense is punishable by prison sentence, if the amount of money is large enough. I know in some other states you cant do this, you have to sue him in court to get your money back. He is definitely over due on having the work done and you need to call the authorities to see what can be done. Don't wait around for him to return your calls he probably won't from what you are saying. HE IS DODGING YOU AND HAS NO INTENTIONS ON COMPLETING THE WORK! And take this as a lesson learned that you never give as much as you have recieved when it comes to draws on construction and remodeling work. And never give a "deposit" on the work! If he doesnt have his act together enough to be bankrolled well enough to buy material he shouldnt be doing the work! Good Luck! Photograph the "small stuff" that's not complete. Then, assuming you have a written contract, let him know that you will take him to court and sue him for the remainder or damages. As it's over $5000, you can't do it in Small Claims. Still, you have a case.

from watching peoples court way to much you should hire another contractor to finish the job , pay them then take the original one to court for the new contractors bill and court costs , just make sure that he breached the contract for sure

File a suit against him for business fraud. You got diddled. A good buisness attourney will be a great help. Talk with a justice of the peace before you do anything else.I hope things work out for you.

You can take him to court, But I do not thing you'll get anything. Did you check to see if he has a license? Did you check his previous work? Probably not!!!! God!! and people, says: there is no Santa!!

STOP BY HIS OFFICE AND INFORM HIM IN WRITTING THAT THERE IS A BREACH OF CONTRACT AND THAT IF HE DOESN'T FINISH UP YOU WILL FIND ANOTHER CONTRACTOR TO FINISH WHAT HE STARTED AND YOU WILL BILL HIM FOR THE DIFFERENCE.
