I have heard that you can be arrested for possession of child porn if you download an animated picture depicting a person under 18 in a sexually expliced manner. This frightens me because sometimes a buddy will email me a comic picture of Bart Simson or Charlie Brown, getting down to buisness with some cartoon girl, and I never gave it a second thought. It's adult humor, in my oppinion, and worth a few laughs. I'd hate to think that I was violating a law by having something like that. I know I'm not a pediphile. I would hate to think that I could be treating like one over comics. Also, I've seen Hentai where the charaters seem to be under 18, and again I never gave it a secong thought because these are cartoons, but from what I've been finding out is that "sim" child porn is as bad as the real thing and just as illegal. I'm guessing that with CG animation advancing the way it is that soon people will hardly be able to tell the difference. But what are that facts?

Therm "animated child porn" is actually what throw you off the track. As the previous poster explained, since no children were involved in creating the images, they aren't child porn- animated or otherwise.

As far as animated Hentai stuff goes, almost every movie has disclaimers at the beginning stating that everyone depicted is over the age of 18. In Japan, censorship laws prohibit the display of pubic hair- that's what accounts for all the girls being hairless. Combined with the traditional japanse style of drawing caucasians with impossibly big round eyes and multi-colored hair, and it's easy for Americans to assume they are depicting children, when they aren't.

Not in the United States.

The Supreme Court ruled on this issue a few years ago, in the case of Ashcroft v. Free Speech Coalition (link below). Essentially, the government interest being protected in making child porn illegal is the protection of the children, and the goal of preventing them from being exploited or harmed during the making of the porn.

Since no actual child are involved in animated porn, no actual children are being harmed. So, the govt interest is not being advanved by prohibiting animated porn, and thus it is legal.
