The best thing for you to do is seek a lawyers advise. A lawyer is your only best option.
But difinitely you cannot just file charges against her without involving your husband.
I fact you have to file charges of concubnage,, it depends on what country you belong.

Start taking some anger management classes. And keep from doing anything else that's stupid. When you go to court just tell the judge you were sorry & your already working on improving your behavior. Try to escape mentally in some way. Pick up a hobby do something & stop thinking about this. Take care of your kids. And you might have to leave your husband for about 6 months or so, at least until you can get everything resolved, maybe ask a close relative or friend if you & the kids can stay with them if you are not working or if you have a job that's flexible enough to accomodate such a move. Don't mention your kids father to them & if they ask try to change the subject without saying i don't want to talk about your father or getting angry. Biggest problem i see are possible interactions with your husband. Keep a cool head & for god sakes don't shoot the guy. Unless you want to be brought up for murder as well as assualt & battery. And i wouldn't do it now but eventually you need to send a letter to the lady you assaulted appologizing for what you did. And if she responds let a friend read it & give it to you if it's a kind response but if it's not don't show it to you. You will get a letter from a lawyer if she brings up charges. So keep track of your mail, & perhaps you should give the lady the address that you're staying at in the letter you send her so she knows you're not fleeing, just cooling your head. Stay away from her. And try to stay away from your husband. And whatever you do don't go on one of those daytime talkshows to find out whether the kid in question is your husband's or not. Besides all those shows do is make fun of you & your situation. And last but not least don't hurt yourself or your kids. And like i said before get away in your head in someway.

I am not sure what it is you are looking for in the way of an answer. You mention something about an affair your husband is supposedly having and then slapping and getting in to a fight with this other woman, and then mention something about a rape that produced a child 4 years ago.

What!?!?!?

Some of these others that tried to give you an answer get an "E" for effort but I don't know how they could hope to know how to answer your question either.

I understand why you assulted her, but you are going to have to own up to it. Ask for a jury trial! Try to get mostly women in the jury~ I would never say you were guilty. Plea emotional distress!

Get a divorce!

And what I don't get is if your husband raped her, are there charges against him?

And why would she keep the baby?

And then why would she have an affair with him 4 years later when he is married?

This woman and your husband both have issues! Clean up the matter with legal help and get as far away from them and their disfunction as possible.

I dont understand why everyone always blames the mistress.. Your husband has the commitment to you, you should kick his *** if anyones. Your only solution is to contact a lawyer.

Just pray. I dont know what the courts does about this. But you just now found out about it and the child is 3 yrs old? And now you go beat her up? Sounds a little fishy.
All in all I would definately leave you husband for sure. Dont worry about the other women so much your husband is just as responsible for his actions. Get mad at him....

Contact Jerry Springer, he would be happy to air your story. You assaulted this girl, which is a crime, and you deserve to go to jail for it. She is not the one you should be mad at, your husband is. You have to be the most ignorant person I have ever seen on here. If that is how you are going to deal with life, then you need to be locked up for a long time. Stop making excuses for your pile of fecal matter husband, and get rid of him. He is an admitted rapist and adulterer. You are a fool! I hope they put your violent butt in the slammer for a long time. First this girl has to deal with your scum bag hubby raping her, then you beat on her too, what a stupid, closed minded, retarded pile of goo you are. I can't wait until you get raped in jail, then maybe you will know how she felt. Then when you snitch, they will beat you down and I hope they shank you several times!

what a mess! If you divorce your husband, I think you can name the mistress correspondant in the divorce action. But stop the physical abuse. It will only reflect poorly on you and your character. Talk to your mother in law...they always know all the information.

I would say you won't go to jail, particularly if this is your first offence but I would suggest you'll be doing some community service in your near future.
