My ex wife has taken the kids from Germany back home to Ireland. She has full custody. My German lawyer says it's out of her hands now that they've left the country. I had access to them every second weekend but she said that was only applicable in Germany. Have I got to go to Ireland and go through the courts there?

Sorry, I can't answer your question but wanted to offer my support. This kind of think really gets to me and i sincerely hope you can resolve the situation.
To be brutal though if it was me i would swallow my pride and try hard to move to Ireland. To be apart from my kids would really kill me and i wouldn't want them flying every second week (if you were able to re-instate the original ruling) unless you planned to go there every week?

The Hague Convention may apply but as another answerer has said, you need a family lawyer. Which part of Ireland? Northern Ireland or Southern Ireland? Their law is different to that of England and Wales but you can instruct your German lawyer to contact an Irish lawyer to act on your behalf. The Irish lawyer can advise about how to go about making an application in the Irish courts for either the children to be returned to you in Germany or else for a contact order so that they get to see you regularly and have telephone and postal contact. You don't need to go to Ireland in person unless there is a contested hearing. Your Irish lawyer will appear in court or instruct a barrister there to appear on your behalf. Good luck.

As shes moved to Ireland you would have to go through the courts within the child's juristriction, yes. As far as I know, there would be nothing to stop you going to Ireland now to visit your kids as it stands.

I also think you should check out and join families need fathers at 'www.fnf.org.uk'. You will get no end of useful information and advice from other people who are going through or have been through similar situations regarding their children.

family lawyer- i hate women who take access away from fathers they forget that children need to see both parents and that she obviously needs to grow up!!
