she was volunteering at a garage sale for a hospital. The interlocking brick has sunk below the curb and she fell while delivering drinks to other volunteers and broke her elbow. Any advice on legal matters would be appreciated

and yeh to all u bitter angry people (sue sue sue) it was at an old age building and it has already been in writing that it is not safe and should have been repaired alontime ago, Yeh and bu the way have you ever had to bathe your 12 year old daughter?????? Not pleasant!!!!! Thanks

She's 12. By now she should have some control over her balance and coordination. Her fault. No one ELSE fell over the curb did they?

SUE SUE SUE! That way you can stay home from work and be fat, lazy and bitter!

The only reason I can see to sue would be if you could not afford medical care for her. Since she is a child I imagine you have some type of health coverage for her. Medicaid will help you pay some medical bills as well if you qualify for public assistance.

Accidents happen and they are no ones fault. I can't understand why these people on here are attacking you and your daughter. Everyone makes mistakes and has accidents. Im amazed someone could profess to be concerned with the state of our society and frivilous lawsuits while spewing hate out everywhere they go. That is hypocritical to say the least. Not to mention mean. Don't let them get you upset.

Im sure you could sue and possibly win a settlement but what would you gain? Some money? That wouldnt really accomplish anything.

I recommend teaching your daughter the "right thing to do" and not sueing for financial gain unless you truly need the help with the hospital and dr. bills. Since she was volunteering for the hospital garage sale its possible they would settle out of court and help you with the healthcare costs if you meet with them and discuss the matter.

I suggest no lawyers.

Since it was a fundraiser for a hosptial, the last thing they need are expensive legal battles and all that hassle for them and for yourself and family. That could end up costing them three or four times the amount of money brought in by this garage sale.

If your daughter was treated by that same hospital, then perhaps you can get the hospital to cancel your medical bills for this. Try to speak with the hospital administrator and see what can be arranged. Also, perhaps the condo property company or condo association will help you out with the expenses.

For now, get the medical bills paid in the usual manner (using your own money or insurance) and keep copies of all the bills and payments. Remember to use all forms of insurance you already have -- for example, you may have private accident insurance so don't forget to file claims with your insurance carrier if you do.

Yes, sue the Hospital for not fixing the brick

Sue the city for not fixing the sidewalk

Sue the brickmaker for making bricks that don't work

Sue the cement maker for making cement that goes into bricks that dont work.

Sue the parents of the kid cuz they had the nerve to let her out of the house when there are disfunctional bricks everywhere in the world! But, i guess you can't sue yourself

Screw it, put a cast on the kid... she will heal and have a funny story to tell one day.

go get a lawyer, sue the pants off the condo owners, the manufacturer of the drink she was carrying, the city, the construction company who made the curb, the hospital and for gp's sake, sue the road builder, the local electric company, the nearest wal mart and for sh*ts and giggles, go for one of the big three - gm, fomoco, or chrysler. after all, its got to be one of them thats at fault because your 12 year old daughter cant look out where she is walking.....................right?

That's the way of our culture. civil suits.

Many other countries have sidewalks and streets not nearly as passable as ours. The people there have to learn more care in their steps.
