Can anyone tell me what the stalking laws are in Texas when both the stalker and the victim are minors? Or point me to a website with information about this, and about getting a restraining order against a minor. Thanks

The issue is a 15 y/o boy that is harrassing and following my 14 y/o daughter. He calls up to 60 times a day, follows her from class to class, follows her around town, and has threatened her and a few of her friends. Have tried talking with his father, with no luck. The school is aware of the problem but they say they can't really do anything.

By what you have described, he has violated the Anti Stalking Statute in Texas a couple of different ways, as defined by the Penal Code. The statute basically states that a person is guilty of stalking if they follow a party repeatedly and make any type of threat or statement that is obscene, threatening bodily harm, or intended to alarm or embarass another person. The same applies to repeat phone calls with the same actions (obscene etc...) or if they call and leave the line open deliberately without saying anything. It is also staking if they cause your phone to ring repeatedly and either initiate conversation or just hang up. They also cannot transmit the same actions by fax, pager, e-mail etc.... It is a 3rd degree felony in Texas.
My advice is that you tell the boys parents 1 time that you are going to call the police if he does not stop, and advise the school of his behavior and your intent to file criminal charges for the same. If the school does not intervene concerning his actions then go to the school resource officer or go to the Superintendent, or even the school board. The very next time it happens, call the police and file a formal criminal complaint and get them involved. You will have to be able to prove that he is doing so, but your phone records and your daughter as well as your own statements should be sufficient to get the ball rolling. If it does not stop, press charges. Even if the child is a minor, it's a crime and he can be arrested. Reality will dawn for this young man when he is taken into custody.
Mcoff80 is correct, particularly about documentation. Document everything.

Most states including Texas have menacing laws and stalking laws and it does protect minors. First of all you need some evidence more than "just my word" to show that stalking has occurred.
Menacing is where a person believes another will cause physical harm or serious physical harm to another person, their family or property.
Stalking is where by a pattern of conduct a person engages in menacing or harasses or causes mental distress to another person.
If all attempts to work it out with the boy, his parents and the school have failed then I would make a report to your local police department.
Here is what I recommend you do to prove your case.
Documentation is everything and it means more than just your word.
Keep a log of phone, text message, and personal encounters with the boy. Keep dates, times, what happended, where, etc.
Tape record everything. In most states (Texas is OK) as long as one person knows the conversation is being recorded it is legal.
Keep all phone records and tape them. Keep all text messages if he is sending them.
Have any witnesses document on paper what they saw or heard, or at the very least log their information and where they can be found.
What you need to show is a pattern of conduct. (Unless actual threats of harm or violence are made) Most states look for two or more incidents in a short period of time.
If he is making threats regarding harm to your daughter or your family or your family’s property make a police report immediately and remember to document.

ew omg wow, that is sick..what a creeper! ha but im not sure if there is, but there should be. maybe you could move? or live with someone else for awhile? or maybe you could video tape him video taping you and show it to the cops? ha ^_^ hope you figure something out!
