Yes. Officers may use devices to enhane their vision in this manner without a warrant. It is merely improving what they can already see, as opposed to using a device like a thermal imaging camera to look through a wall and try to determine what is on the other side.

Almost all forms of surveillance equiptment (Cameras, Binoculars, still image surveillance, etc) is legal for investigations and surveying purposes by law enformcement officials.
On the other hand, recording audio without warrant is illegal in many states. Many forms of "citizen protection" laws prohibit admission of audio recordings unless it passes mutliple compliance and retrieval laws within the state.
Also, the statement made that there is no way to see through walls is inaccurate. It is correct that thermal imaging cameras can only detect forms of heat. However, there are Thermal Biometric surveillance systems that can recognize a subject through up 1 foot of concrete. Once the subject's image is aquired through a mega-pixel CCTV camera, the video clip is recorded into a Biometric software that assigns a "Biometric Map" of the subjects thermal signatures. The subject is now "marked" and can be recognized anywhere through his individual "Biometric Map". The subject can walk into an enclosed convention hall, airport, sports stadium, etc with thousands of people and still be precisely detected from a helicopter circling above the building, "seeing through walls".

They do use a form of thermal imaging Forward looking inferred on the helicopters { night vision] And yes it is legal.

It is illegal if they are using the NICI system to look up imfomation for thier own use or non official use. If they want to request a back gound off the internet or pay for one from the Police department, thats not illegal. Anyone can request a background for any one.

Not only legal, but highly recommended. Too many cops too close to a drug deal would get spotted.

yes, currently they have to have a warrant to use heat sensor equipment to tell who is in a building.
