It's been about six months now and still no state taxes have been withheld. They withheld taxes for the wrong state from my first two checks and now nothing since. Their excuse is that ADP (the company that handles our direct deposit transfers) isn't getting the tax ID number. I've paid estimated tax myself for two quarters this year now, but I don't want to have to keep doing that, especially since the payroll person is supposed to be handling it.

I live in Minnesota and my employer is in California. I travel to different clients that have contracts with my employer. My coworkers, who travel from Illinois, Arizona, and Idaho, have not had problems with their state taxes being withheld.

ADP operates on the info they're provided. The excuse your empolyer provided is just that--an excuse. If their payroll company is in error and they know it, they are still liable for the taxes and should be correcting the situation on their own. Contact your state franchise tax board and tell them what is going on. They will take it from there. I'd provide better info if you could manage to provide the state in question in your question.

Are you working in a different state than the one you live in? From what you say about withholding being done for the wrong state at first, it sounds like that might be the case. If so, that might get a little complicated - the company is probably not required to withhold taxes for a state they don't operate in, and it might cost them extra for ADP to do it.

If ADP 'isn't getting the tax ID number', the reason is that your employer isn't giving it to them. In other words, they are blaming ADP for their own error. Contact the state taxing authority. They can make fixing the problem much less expensive than ignoring it.

It is up to the employer if they choose to file taxes on your behalf. You can be 1099ed at the end of the year, but that doesn't sound like what is going on. If it were me, I would probbaly report them. They could be messing around and you don't want that to come back to you.

report them to the state, you will not have any more problems
