There is a period of time where the person can carry the virus, but the HIV test will come back negative. In all types of sex, it's always better safe than sorry.

It's my understanding at this time, the theory is no. However please note I said Theory--meaning the facts are not a certain, but that is the current theory. A very good question, and one I've heard before working in health care. One thing I'm certain of that there is more unknowns, than concrete things in medicine, and Health care.
