if someone gave you herpes and you could proove they did. could you sue them?

Yes you can. If they gave you an incurable STD then you have the right to sue them. There are 2 reasons that you couldn't. If they told you got together that they had it and you took the chance anyway then you couldn't. If they didn't know that they had the disease then you can't sue them. The reason for suing them has to be because they did it purposely. If they didn't know about it then you can't blame it on them. If they did know about it and didn't tell you then you have every right to and good luck. I hope this helps.

Theroetically....yes. You could retain a lawyer, who can petition the accused's medical records be disclosed--for they may contain information that he/she DID KNOW of their herpes condition BEFORE infecting you.

But here's the rub: the defense can lie outright and say "but your Honor....my client DID tell this person of their herpes condition....and still this person threw caution to the wind......"

So.....next to the medical records disclosure, getting them on audio/video tape admitting they knew is the mother of all time hardcore evidence you'd need for your case.

Michael Vick of football fame was sued for giving a girl herpes...he did it under the alis Ron Mexico. Do any kind of web search on this and you should see about the lawsuit and battle and all the fun stuff.

You would have to have a consultation with a lawyer to find out for sure. But I am pretty sure that you can only sue someone if they give you HIV and knew they were positive before they slept with you.

No. You take a risk every time you have an unprotected sexual encounter with someone. Maybe they'll sue you and say you gave it to them.
