Okay heres my story, i got pregnant at 15 and me and the babys father stayed together, i am seventeen now and we are married, when he was 15 he got into trouble with the law from fleeing in a car. He's got a felony on his record and he is not from this country. Now we got a letter in march saying that he was to be deported. Without him me and our daughter will not be able to survive. We got married in april this year. We have seen a lawyer and everything. I just don't know what to do. I have heard that if we a re married they can't deport him, does that count if he has a felony though? Please if anybody can help me i would be very thankful.

It is wrong for you to think that without "him" you will not survive. Unfortunately you are a victim of your own irresponsibility. I would prepare for the worst and hope for the best. There are tons of places a young mother can get help. I would turn to your parents first. I am not suggesting that you accept defeat right now but if you see the eventual outcome being that he will be deported, i would start to find a way to look to a future rather than looking at the past.

Most times if someone is married to an American citizen they cannot be deported. however, the felony charge does work against him. From what I understand to keep him the country you have to prove fianicially that you could not support yourself. I'm not sure what kind of proof they want though. Your lawyer should be able to tell you.

Cmeand3 is correct. His being married to you will not stop his deportation. You can petition for him when you turn 18, but although the petition will be approved (based on the relationship) he will not be allowed into the US because he is inadmissible for ten years under section 212a2 of the Immigration and Nationality Act, which says:

(9) ALIENS PREVISOUSLY Removed.-

(ii) ...Any alien ...who-

(I) has been ordered removed under section 240 or any other provision of law, or

(II) departed the United States while an order of removal was outstanding, and who seeks admission within 10 years of the date of such alien's departure or removal (or within 20 years of such date in the case of a second or subsequent removal or at any time in the case of an alien convicted of an aggravated felony) is inadmissible.

See? It says nothing about "unless he's married to a dim-bulb US citizen."

You can request a "hardship" waiver of his inadmissibility after he is refused, but it is not likely to be granted since you married him AFTER he was already ordered to leave.

Should have kept your legs closed. So not only is he illegal, he committed statutory rape as well. Nice catch, you got a real winner! God, I hope they deport him ASAP. Well you didn't say how old he was when you got pregnant, so I am assuming he was over 18.

I guess you are now experiencing consequences of your actions. Don't blame anybody but yourself. Girls at 15 should not be having sex. You should have kept your legs closed.

If he isn't a citizen they can deport him.
It doesn't matter you are married.
