It is illegal in any state. You will get a fix-it ticket at worst. In some places, it could be considered a moving violation.

And it's just plain unsafe to drive a car like that.

I believe that if you have a side view mirror on both sides of your vehicle then you need not have a rear view mirror. I know this is true of trucks which have their rear view impared. I would suggest that you check with the DMV just in case.
