I live in Illinois and I need to know how to find laws like is it legal for a cop to stop a person while off duty? how do I research that?or does anyone know a link?

Ok babe. enter your zip code here. When it comes up pick which is best for you and start LOOKING. Answers can't always help, sometimes it's good old fashioned leg work. ;)
Sometimes the particular department may have guidelines that are an extension of the STATE law. It may be wise to find the manual for that department somehow.
Find GOOGLE and start typing to research. I found most of the findlaw in 3 searches by narrowing down my wording. Stay cool!!

I think the above answer, Hot Slaw, is better than mine. You have to notice it says NOTHING about OFF-DUTY. I would, however, look into the fact he flashed the badge. The standard operating procedure for his department may be infringed upon by him doing it the way he did. The department he works for will still look at that more than than will the state law for reprimand.

You can call the clerk of courts for your county, and they will be able to help you. Most links that cover law specifically are only accessable by lawyers. You could contact the DOT for your state as well, or go onto your county or state government website and find out.

But I can tell you the answer: It is an officer's duty to uphold the law. If they notice someone breaking the law, and they are off duty, they are obligated to step in and aprehend the individual. So if you were speeding and the off duty officer noticed it, then he can ticket you. Sorry about that!!

(725 ILCS 5/107‑16)
Sec. 107‑16. Apprehension of offender. It is the duty of every sheriff, coroner, and every marshal, policeman, or other officer of an incorporated city, town, or village, having the power of a sheriff, when a criminal offense or breach of the peace is committed or attempted in his or her presence, forthwith to apprehend the offender and bring him or her before a judge, to be dealt with according to law; to suppress all riots and unlawful assemblies, and to keep the peace, and without delay to serve and execute all warrants and other process to him or her lawfully directed.

well to answer the question about being stopped yes i'm sure they can and in illinois they really stretch the law to the limit

What you are trying to do is legal research. It is best done thru a service such as lexis which, unfortunately, is not free. It is available at some Universities.

well, I don't know where you can find that ...but...yes it is completely LEGAL for a cop to stop you if they are off duty.
