I'm just wondering if your retarded and that you committed a crime do you still get sent to jail or will they just let you free?

No. you can not be sent to jail if you are retarded ( SPECIAL ) Unless you commit a crime, or pose a threat to your self or others.

I'm sure there are many mentally retarded people in the prison system who have never been formally tested or recognized as such. The same probably goes for psychotic and demented individuals, no doubt.

Im not sure retarded is the word you are looking for.But if your trying to ask if people with menatl disabilities and disorders go to jail,the answer is no.People in this category are usually sent to be hospitalized and institutionalized.

I don't think they will be sent to jail since they do not know how to handle themselves in prison or what to say in court. They will probably just be sent to a mental institution. But you need to know what to say or what to do when you go to prison.

I do believe that if they are mildly retarded that yes they can be sent to jail.
I don't know what happens if they are severely retarded, though.

That is where the competency hearing comes into play. The person may just be hospitalized in a mental facility.
