No it's not illegal unless you're approaching a prostitute, they're supposed to ask you (apparently).
If you know someone who's interested enough in you to do it then just ask them "Would you consider having sex with me? If not I won't be offended, but I find you very attractive, and I know you like me so I thought that it may be good for both of us."

You open your mouth and speak... why would you think telling someone that you want to have sex is illegal? Trying to solicit sex from someone is illegal...

How do *I* do it? Usually I see if I'm allowed to kiss the person first. If I am, and if that seems promising, I ask if they want to take it further.
