I have a derogitory report on my credit I am trying to get removed and I've been looking at a few different ways to do it......I found one way where you demand "Validation" from the collection agency.

What happens if the derogitory charge is still with the original creditor?

Its been 5 1/2 years and it still seems to be with the same company. I think it was purchased by Citibank but it still lists
the same original information through Transouth.

Is there a way to still dispute this?

Do you use a different tactic?

Many times if you ask a credit reporting agency to dispute charges on your credit report, all they check is to see if that creditor has your name and an address in their records. They don't check the validity of the report.

No repo.....Its a charge-off.
I voluntarily returned the vehicle.

Are you out of your states statute of limitations (SOL) for collecting the debt?
If not, disputing it could lead to a lawsuit.

Yes you can send the collection agency a debt validation letter. Send it certified mail return receipt.
Then, when you get the green card back, send a dispute to the credit bureaus. Find one or two inaccurate things on the tradeline and use them for your dispute.

If the collection agency verifies with the bureaus before validating with you, it is a violation.

I just noticed that you had another question about Citibank Auto. Is this for a repo?
If it is, everything would be handled differently. And repo's fall under the UCC for SOL, which would be 4 years.

I would suggest going to the site I've listed. Do some reading in the newbie forum and then in the credit forum. You will be able to find more info on that site than I can even begin to list on here.

After you have done some reading in those forums and have questions, feel free to post them in the credit forum.

Even if you voluntarily returned the vehicle, it is still considered a repo.
It will show on your credit reports as a charge off even though it was a repo.

Did they ever send you the required notices? The intent to sell and the deficiency notice after the sale?
If they did not send the notices or sell the vehicle in a timely and reasonable manner, the repo would be considered an illegal repo and any money due for the deficiency would be deemed uncollectable.

Also, repo's fall under the UCC 9 for collections, which gives them a 4 year SOL for collecting.

I would suggest going to the second site I've listed and look under the Special Purpose Letters, click on the Letter to Dispute repossesion Deficiency.

Read that page fully and follow all of the steps listed.

There is also a dispute letter to the credit bureaus, on that page. You would use that letter you don't get a reply, after 14 days, from the companies that you send the first letter to.

Contact the credit agency and dispute the claim.

tell the credit company you dispute everythign on your credit report they will contact all the companies and they will have 90 days to show that the debit is valid, if they do not respond they will be removed from your credit report.
